Terms & Conditions
By accessing this website and using the services of Mike Palmer Photography, you accept and agree to the following terms of this agreement, as governed by English law.
GENERAL - Mike Palmer Photography owns all equipment at all times, the client is only paying for the agreed service. If Mike Palmer Photography is unable to fulfil the contract any refund is limited to the fee agreed at the time of booking. A pro rata reduction in fee will be granted for a delayed start that is the fault of the company. It is not the responsibility of the company to oversee or manage crowd control. The company will cease the shoot if the guest’s conduct or behaviour is deemed dangerous or inappropriate. In such cases no refund will be issued. Any malicious damage to equipment will be invoiced to the client.
SERVICES AND DELIVERABLES - Services and deliverables will be outlined during the initial enquiry and quotation process. Any additional services and deliverables required, outside of the original specification and quotation, will incur further charges.
COPYRIGHT AND INTELLECTUAL PROPERTY - The copyright of ALL images captured, displayed and delivered, along with the content of this website belongs to Mike Palmer Photography. Any surrender of Copyright must be approved via written consent provided by Mike Palmer Photography and will incur a fee. Any image(s) captured may be used by Mike Palmer Photography for marketing or promotional purposes, including blogs. ALL images created and supplied by Mike Palmer Photography MUST NOT receive any additional modification or manipulation (including social media ‘filters’) and must be displayed as provided by Mike Palmer Photography. Licensing fees and terms for commercial clients will be discussed at the quotation stage.
LIABILITY AND INDEMNITY - Mike Palmer Photography warrants and declares that every effort will be made to provide high quality photographic services. In the unlikely event of severe medical, natural, or other emergencies, it may be necessary to retain an alternative Photographer. Mike Palmer Photography will make every effort to secure a replacement Photographer able and/or willing to provide a similar package as chosen in this contract at the same/similar tariff. If such a situation should occur and a suitable replacement is not found, responsibility and liability is limited to the return of all payments received for the event package. Mike Palmer Photography takes the utmost care with respect to exposure, transportation and processing of photographs; including using professional grade equipment and professional grade back-up equipment. However, in the unlikely event of The Client’s photographs being lost, stolen or destroyed for reasons within or beyond Mike Palmer Photography’s control, the latter’s liability is limited to the return of all payments received for the event package. The limit of liability shall not exceed the contract price stated herein. The limit of liability for partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. In booking Mike Palmer Photography, the client has taken into consideration the photographer’s style and are granting Artistic Licence in all aspects relating to the photography. The Photographer’s judgement regarding the locations or poses and number of images taken shall be final. Due to the vagaries of the weather and the willingness of the subjects it may not be possible to capture all of the images requested. If the subjects refuse or are reluctant to cooperate or conform to the suggestions of The Photographer it might affect the final quality and artistic impression of the images produced for which The Photographer will not be responsible. The Photographer cannot be held responsible for the weather or the effect this may have on the images.
ARCHIVING - The Photographer will make every effort to archive the images for at least one year, if not indefinitely. However, The Photographer makes no warranty about the nature of his archive past the date of the delivery of the first order. The Client should treat the delivered images carefully and in case of digital files it is recommended you keep a safe copy on your own devices.
CANCELLATIONS - In the event of a cancellation the deposit will be forfeited, any further balance that has been paid will be refunded. A cancellation on the day of the event may generate charges to cover the company’s losses (i.e. mileage costs). Rescheduling is commonplace with regard to poor weather.
PAYMENT TERMS - A £100 deposit is required to confirm the booking. The date will be held for a ten day period to allow for payment of deposit. Deposits are not refundable, unless otherwise stated (some deposits are used to confirm the booking only and are refunded on completion. This is applicable when the guests are paying for prints during the event and no charge is made to the client). The balance must be paid no later than 14 days before the event.
